PRIVACY POLICY
Introduction
This policy sets out how your personal information is collected, used, disclosed and protected when you visit our website and use our online business directory and e-commerce multi-vendor marketplace called Watersorted. Personal information is information about an identifiable individual (a natural person).
References to we, us and our in this policy refer to Water Software Solutions Limited (WSSL).
We comply with the New Zealand Privacy Act 2020 (the Act) when dealing with personal information.
This policy does not limit or exclude any of your rights under the Act. If you wish to seek further information on the Act, see www.privacy.org.nz.
This policy was drafted with brevity in mind. It does not provide exhaustive details of all aspects of our collection and use of personal information. We are happy to provide any additional information or explanation. Any requests for further information should be sent to support@watersorted.com.
Capitalised terms not separately defined in this policy have the meaning given in the Watersorted platform terms of use (Terms).
Changes to this policy
We may change this policy by uploading a revised policy onto the website. The change will apply from the date that we upload the revised policy.

When does this Privacy Policy apply
This policy sets out how we will collect, use, disclose and protect your personal information when you visit and use our website, including all subdomains on our website (together, website), Watersorted (the business directory and e-commerce multi-vendor marketplace operated via the website), and all related products and services, or when you otherwise deal with us or a user of Watersorted or the website.
If you provide your personal information to any other user of Watersorted or the website (for example, if you provide personal information to a business who sells, offers for sale, or advertises, products or services on Watersorted or the website), that other user will have its own policy relating to your personal information. We cannot control, and are not responsible for, how any other user of Watersorted or the website uses your personal information.
Who do we collect your personal information from
We collect personal information about you from:
▲ you, when you provide that personal information to us, including via the website, Watersorted, and any related service, through any registration or subscription process, through any contact with us (e.g. telephone call or email), when you use any chat, message, review or RFQ function to send messages to us or other users through Watersorted or the website, or when you buy any services and products made available to you in connection with Watersorted
▲ third parties where you have authorised this, the information is publicly available, or where those third parties are other users of Watersorted and they share your personal information with us in connection with their, or your, use of Watersorted or the website. This includes, but is not limited to, when you purchase products or services from a user of Watersorted.
Where possible, we will collect personal information from you directly.
You are under no obligation to provide any personal information. However, if you choose to withhold requested information, we may not be able to provide you with certain services or functionality.
Some payments for Watersorted are processed independently by our third party payment provider, Stripe. We use Stripe for payments, analytics, and other business services. Stripe collects and processes personal data, including via cookies and similar technologies. The personal data Stripe collects may include transactional data and identifying information about devices that connect to its services. Stripe uses this information to operate and improve the services it provides to us and to users of Watersorted, including for fraud detection, loss prevention, authentication, and analytics related to the performance of its services. We do not have access to, or store, your credit or debit card information.
You acknowledge and agree that any credit card and billing and payment information that you provide to us may be shared by us with companies who work on our behalf, including payment processors and/or credit agencies for the purposes of checking credit, effecting payment to us or to other users, and servicing your account.
How we use your personal information
We will use your personal information:

▲ to provide Watersorted, and other services and products, to you and to other users of Watersorted and website, including enabling you to make payments for goods and services

▲ to improve Watersorted and other services and products that we provide to you and/or to other users of Watersorted, including by analysing how you interact with Watersorted and the website, and any related services or products
▲ to check the contents of any Listing, Advertisement or other content on Watersorted or the website
▲ to enable users of Watersorted and related services and products to communicate with each other
▲ to meet the purpose for which a party provided the information, including any purpose described in or contemplated by the Terms
▲ to resolve disputes, including any dispute between users of Watersorted or the website, or any dispute between a user and us
▲ to bill you and to collect money that you owe us, including authorising and processing credit and debit card transactions
▲ to respond to communications from you, including a complaint
▲ to conduct research and statistical analysis (on an anonymised basis)
▲ to protect and/or enforce our legal rights and interests, including checking your compliance with the Terms, enforcing our agreements with users of Watersorted or the website or any third party, defending any claim, and reviewing the content of any communication made available via Watersorted by any method

You can unsubscribe from any marketing communications from us by following the instructions on any marketing communications sent to you. You can also exercise this right at any time by contacting us using the details at the end of this privacy policy.
Personal information included in listings, advertisements, reviews, messages, and other communications
If you add a Listing, an Advertisement, a review or any other publicly available message to Watersorted or the website, the information that you include in that Listing, Advertisement, review or other message will be publicly available to all visitors to the website. You should ensure that, when setting up any Listing, Advertising or other communication of that kind, or when a person is doing so on your behalf, the Listing, Advertisement or other communication only includes information that you wish to be available to other people.
If you participate in any chat, messaging or other communication service made available via Watersorted or the website, the information that you include in those communications will be available to us and to third parties, including any recipient of that message and any provider of intermediary communication services. You should ensure that, when using any chat, messaging or other communication service, your messages only include information that you wish to be available to other people.
We do not accept any responsibility to monitor all communications made via Watersorted or the website, but we reserve the right to access, monitor and review those communications, regardless of whether or not they are publicly available, in the circumstances and for the purposes described in the Terms.
General disclosure of your personal information
We may disclose your personal information to:
▲ any business that supports Watersorted, the website, or any other services and products we make available to you or other users of Watersorted, including any person that hosts or maintains any underlying IT system or data centre that we use to provide the website, Watersorted, or those other services and products, including (but not limited to) content delivery services, site security and monitoring services, marketing services and customer relationship management services
▲ other users of Watersorted in the circumstances described in, or otherwise contemplated by, the Terms or as otherwise reasonably contemplated by your use of Watersorted. For example, if you include personal information in a message, chat, Listing, Advertisement, RFQ-related message or similar communication using functionality available via Watersorted or the website, we will make that personal information available to the relevant users of Watersorted, and (in some cases, e.g. Listings, Advertisements and reviews) to the public
▲ if there is a User Dispute, or if a User contacts us about a dispute, we will share the details of the dispute and the contact details of the relevant Users, between the Users who are parties to that dispute in the manner contemplated by the Terms
▲ a credit reference agency for the purpose of credit checking you
▲ other third parties (for anonymised statistical information)
▲ a person who can require us to supply your personal information (e.g. a regulatory authority)
▲ any other person authorised by the Act or another law (e.g. a law enforcement agency), or where we believe in good faith that disclosure is necessary to (i) satisfy our legal obligations; (ii) detect, prevent or otherwise address fraud, security or technical issues in connection with Watersorted, the website, or our products and services; or (iii) protect against imminent harm to the rights, property or safety of us, our users, or the public at large
▲ any other person authorised by you.
If you access or use Watersorted or the Website in your capacity as an Account Member, or otherwise as an officer, employee, consultant, contractor or agent of an organisation, we may also disclose your personal information to any person we believe to be an authorised representative of that organisation. If you have questions about that organisation’s access to, and use of, your personal information, please contact the relevant person in that organisation.
If you access or use Watersorted or the website as a result of or in connection with any interaction with an affiliate of ours (e.g. where an affiliate has given you a code to use if/when you create an account to use Watersorted), we may also disclose your personal information to that affiliate to the extent reasonably necessary to comply with our obligations to that affiliate or to confirm the affiliate’s compliance with the Terms, including to calculate and pay to that affiliate any compensation earned by them or to resolve any dispute with them.
A business that supports Watersorted, the website, and/or our services and products may be located outside New Zealand. This may mean your personal information is held and processed outside New Zealand. The disclosure of your personal information to a country outside New Zealand may take place where (i) we believe on reasonable grounds that the recipient is subject to privacy laws that, overall, provide comparable safeguards to those in the Act; (ii) we believe on reasonable grounds that the recipient is subject to privacy laws of a country prescribed under the Act; or (iii) we otherwise believe on reasonable grounds that the recipient is required to protect the information in a way that, overall, provides comparable safeguards to those in the Act (for example, under an agreement entered into between us and the recipient).
We may transfer your information in the case of a sale, merger, consolidation, liquidation, reorganisation or acquisition.
Protecting your personal information
We will take reasonable steps to keep your personal information safe from loss, unauthorised activity, or other misuse.
You can play an important role in keeping your personal information secure by maintaining the confidentiality of any password and accounts used in relation to Watersorted and any other products and services, and by limiting the personal information you include in Listings, Advertisements, and any other communications relating to, or made via, Watersorted or the website. Please notify us immediately if there is any unauthorised use of your account or any other breach of security.
Accessing and correcting your personal information
Subject to certain grounds for refusal set out in the Act, you have the right to access your readily retrievable personal information that we hold and to request a correction to your personal information. Before you exercise this right, we will need evidence to confirm that you are the individual to whom the personal information relates.
In respect of a request for correction, if we think the correction is reasonable and we are reasonably able to change the personal information, we will make the correction. If we do not make the correction, we will take reasonable steps to note on the personal information that you requested the correction.
If you want to exercise either of the above rights, email us at support@watersorted.com. Your email should provide evidence of who you are and set out the details of your request (e.g. the personal information, or the correction, that you are requesting).
Subject to applicable law, we may charge you our reasonable costs of providing to you copies of your personal information or correcting that information.
Internet use
While we take reasonable steps to maintain secure internet connections, if you provide us with personal information over the internet, the provision of that information is at your own risk.
If you include your personal information in a review, Listing, Advertisement or other communication via Watersorted that is publicly displayed on Watersorted or the website, you acknowledge and agree that the information you post is publicly available.
If you include your personal information in any communication that is not publicly displayed on Watersorted or the website, you acknowledge and agree that the person to whom that communication is addressed (and any other person who might reasonably be expected to receive that communication as contemplated by this privacy policy or the Terms) will receive that information and may share it with others. You also acknowledge and agree that we reserve the right to monitor communications made via Watersorted or the website in accordance with the Terms.
If you follow a link on the website to another site, the owner of that site will have its own privacy policy relating to your personal information. We suggest you review that site’s privacy policy before you provide personal information.
Cookies
We use cookies (an alphanumeric identifier that we transfer to your computer’s hard drive so that we can recognise your browser) to monitor your use of the website. You may disable cookies by changing the settings on your browser, although this may mean that you cannot use all of the features of the website.
